NARCO Bankruptcy and Trust History

North American Refractories Company filed a voluntary Chapter 11 petition on January 4, 2002. As part of the company’s reorganization, the NARCO Asbestos Trust was established on April 30, 2013 pursuant to the Third Amended Plan of Reorganization.

The Trust was created to resolve NARCO Asbestos Trust Claims and NARCO Asbestos Demands caused in whole or in part by exposure to asbestos-containing products manufactured, sold or distributed by NARCO or its predecessors for which NARCO and/or Honeywell International Inc. and covered predecessors, successors or assigns have legal liability.

The Trust began accepting claims on October 15, 2013.

Disease Levels and Scheduled Values

The current official FAQ publishes the following Expedited Review Scheduled Values for ACC and PEU claims:

Disease Level Disease Expedited Review Scheduled Value
VII Mesothelioma Yes $75,000
VI Lung Cancer 1 Yes $18,000
V Lung Cancer 2 No Individual Review only
IV Other Cancer Yes $9,000
III Severe Asbestosis Yes $18,000
II Asbestosis/Pleural Disease Yes $7,500
I Other Asbestos Disease Yes $1,200

The Trust separately publishes current Average and Maximum Values for applicable Individual Review claims. Because those values are maintained in a distinct current-year notice, this page does not substitute older figures or infer values that were not independently verified from the current notice during this build.

Current 100% Payment Percentage

The official NARCO Trust website and FAQ currently state a 100% Payment Percentage.

For Expedited Review, the Trust states that payment is the current Payment Percentage multiplied by the applicable Scheduled Value. For Individual Review, payment is the current Payment Percentage multiplied by the gross settlement value determined under the TDP.

Mathematical illustration only — not a guaranteed payment. At the current 100% Payment Percentage, a qualifying Mesothelioma Expedited Review claim liquidated at the $75,000 Scheduled Value would mathematically produce $75,000. A claimant must still satisfy all medical, exposure, filing and procedural requirements before payment is available.

ACC, PEU, PEL and Indirect Claims

NARCO uses several claim categories that should not be conflated.

Annual Contribution Fund Claims (ACC) generally include NARCO Trust claims that do not fall within the Pre-Established Claim categories. ACC claims can be submitted for Expedited Review or Individual Review as permitted by the TDP.

Unliquidated Pre-Established Claims (PEU) generally include specified claims filed and served against NARCO or Honeywell in the tort system before the January 4, 2002 Petition Date or certain claims subject to qualifying post-petition, pre-effective-date Honeywell settlements.

Pre-Established Liquidated Claims (PEL) involve specified claims whose value had already been fixed by a qualifying settlement agreement or final judgment under the TDP’s definitions.

Indirect Claims are claims by entities that paid in full an obligation for which the Trust otherwise would have had liability to an injured person.

Medical and Exposure Requirements

Each Disease Level has specific medical and exposure criteria. Simply showing that a claimant worked at a site appearing on a NARCO Worksite List does not by itself establish a compensable claim.

The Trust explains that one method of establishing presumptive exposure can require proof that the injured person worked at a listed site during the stipulated period, worked in a qualifying NARCO presumptive occupation and industry pairing, and satisfied Significant Occupational Exposure or cumulative-exposure requirements where applicable.

Claims that do not fit the presumptive charts can still require competent and credible evidence showing occupational exposure to a NARCO asbestos-containing product.

Secondary Exposure Claims are permitted but must be evaluated through Individual Review. Extraordinary Claims and Exigent Claims also have separate criteria under the TDP.

2026 Filing and Claims Processing

Effective January 1, 2026, the NARCO Trust transitioned claims processing to the Delaware Claims Processing Facility (DCPF). The official Trust then announced on January 12, 2026 that it was accepting new claim submissions.

DCPF currently processes Expedited Review, Individual Review, Liquidated Pre-Established and Indirect Claims for the NARCO Trust.

The official Documents page provides the current claim forms and filing instructions, including separate forms for Expedited Review, Individual Review, Indirect Claims and Liquidated Pre-Established Claims. It also publishes NARCO product references, exposure directives, presumptive exposure charts, worksite materials, releases and other supporting documents.

As of September 2026, the Trust also publishes current queue information to help claimants estimate review timing. The September 1, 2026 queue update listed weekly averages of 108 initial reviews and 105 re-reviews.

Expedited, Individual and Special Review

Expedited Review is designed to provide a less burdensome route for claims that satisfy presumptive medical and exposure criteria. It provides fixed Scheduled Values for qualifying Disease Levels.

Individual Review evaluates the claim’s particular facts and may result in a gross settlement value above or below the Scheduled Value, subject to the TDP. Lung Cancer 2, Foreign Claims, Secondary Exposure Claims, Extraordinary Claims and Exigent Claims must be evaluated through Individual Review.

An Extraordinary Claim can include qualifying Disease Level III–VII claims involving unusually concentrated NARCO exposure, including certain NARCO manufacturing-facility exposure or situations in which at least 75% of the claimant’s asbestos exposure resulted from a specific NARCO asbestos-containing product and substantial recovery elsewhere is unlikely.

An Exigent Health Claim can receive special treatment when the TDP’s disease criteria are satisfied and a physician provides the required sworn evidence that there is substantial medical doubt the injured person will survive beyond six months because of the asbestos-related disease.

The Trust’s current Documents page includes a 2025 Annual Report and a 2025 Average and Maximum Values notice. Current total assets, cumulative claims paid and lifetime dollars paid are not reproduced here because the underlying values were not independently extracted from the current official annual-report exhibits during this build.

Prior work around refractory or high-temperature materials does not automatically establish NARCO exposure, Trust eligibility or compensation. Eligibility depends on diagnosis, qualifying NARCO product exposure evidence, medical documentation, current Trust procedures, claim classification, filing requirements and individual circumstances. Compensation is not guaranteed.
