Once a qualifying reorganization is confirmed, the trust evaluates claims under its governing documents rather than through an ordinary lawsuit against the reorganized debtor for those channeled liabilities.

Scheduled Values and Payment Percentages

Many asbestos trusts assign a scheduled value to an approved disease category. Mesothelioma typically receives a higher scheduled value than nonmalignant asbestos disease, but every trust’s values are different.

A scheduled value is not necessarily the amount paid. Many trusts apply a payment percentage to the allowed claim value. GAO explains that payment percentages are used to help preserve assets so current and future claimants can be treated under the trust’s governing rules.

For example, if a trust has a $100,000 scheduled value and a 10% payment percentage, the mathematical result is $10,000. That example explains the calculation only; it does not establish a real claimant’s eligibility or guarantee payment.
