Why These Asbestos Trusts Matter

The Trust’s official website states that it was established under Combustion Engineering’s confirmed reorganization plan to process, liquidate and pay valid asbestos personal-injury claims. Verus Claims Services is identified as the claims administrator. The Trust’s April 1, 2026 notice reduced the payment percentage to 15.3%.
T H Agriculture & Nutrition, L.L.C. Asbestos Personal Injury Trust. The official THAN website states that the Trust was created in 2009 following confirmation of the company’s Chapter 11 plan. It processes present and future asbestos personal-injury claims under its TDP. The latest payment-percentage notice displayed in the Trust’s official notice archive is dated April 22, 2020; a newer percentage should not be invented without a later authorized notice.
Hercules Chemical Company, Inc. Asbestos Trust. The authorized claims site lists an August 22, 2008 petition date, February 9, 2010 effective date and May 8, 2011 initial claims filing date. It currently displays a 2.0% Payment Percentage effective October 17, 2022.
Babcock & Wilcox Company Asbestos PI Trust. B&W is another major industrial and boiler-related asbestos trust. Its payment percentage has been redetermined over time, illustrating why a claimant should use the newest authorized notice rather than a historical percentage copied from an older article.

Industrial Process Asbestos Exposure
Industrial asbestos claims can involve workers who installed, operated, repaired or removed equipment and materials in high-temperature or high-pressure systems. Potential exposure circumstances may include:

A Scheduled Value is also not the same as the amount a claimant receives. Where a trust uses a Payment Percentage, the applicable liquidated claim value generally must be considered together with the current percentage and the governing TDP.

Some trusts permit electronic submissions and bulk filing by authorized filers. Others impose filing fees, releases, audit requirements, statutes or limitation provisions, or special procedures for secondary, foreign or indirect claims.
Claimants should verify the current version of every form and notice before submission because trust procedures and payment percentages can change.
How to Compare Different Trusts Accurately
Trust comparisons should keep several concepts separate:
- Historical funding is not current assets. The amount initially contributed to a trust should not be described as the amount currently available.
- Scheduled Value is not guaranteed compensation. A current Payment Percentage or other payment rule may substantially change the amount paid.
- Payment Percentages are trust-specific. A percentage from Combustion Engineering cannot be applied to Hercules, THAN, B&W or another trust.
- Bankruptcy claims are not the same as paid trust claims. Claim counts from a debtor’s bankruptcy should not be presented as the number of claims paid by the resulting trust.
