Why Automotive Asbestos Claims Exist

The Bankruptcy Court confirmed the Modified Joint Prepackaged Plan on May 17, 2019, and the Maremont Asbestos Personal Injury Trust was established on July 9, 2019. The Trust began accepting asbestos personal-injury claims on October 21, 2019.

Maremont is especially relevant to automotive exposure because its TDP and current filing materials address both Occupationally Exposed Claims and a distinct Shade Tree Mechanic process. The Trust published updated Shade Tree Mechanic affidavit guidelines on January 13, 2025.

An official April 7, 2026 notice confirms that the Payment Percentage currently applied to Maremont Occupationally Exposed Claims is 28.4%. The Trustee was reconsidering the percentage, so the rate remains subject to change under the TDP.

Federal-Mogul Automotive-Related Claims

The Federal-Mogul Asbestos Personal Injury Trust was established under Federal-Mogul’s confirmed Chapter 11 reorganization. The official Trust Agreement identifies six historical liability streams: T&N, Flexitallic, Ferodo, Federal-Mogul Products, Fel-Pro and Vellumoid.

Ferodo is particularly relevant to friction-product exposure. The Trust’s claim instructions require a claimant filing against the T&N Subfund to identify whether the alleged exposure is against T&N, Flexitallic or Ferodo. Multiple exposures within that structure can require separate claims.

The Trust Agreement also creates separate T&N, FMP, Fel-Pro and Vellumoid subfunds. Federal-Mogul: the official claim instructions publish entity-specific values. For example, the T&N Subfund instructions list a $200,000 Mesothelioma Scheduled Value for T&N claims but a $50,000 value for Flexitallic/Ferodo claims. This category page does not present a single Federal-Mogul payment figure because separate entities and subfunds must be evaluated individually and current payment percentages should be verified for the particular claim before calculating a payment.

The Maremont 2025 Annual Report states that 8,229 claims had been submitted from inception through December 31, 2025, including 1,089 during 2025. During 2025 the Trust liquidated and paid 166 claims totaling $2,089,734 after application of the Payment Percentage. These figures apply to Maremont only and are not industry-wide automotive-trust statistics.
