Eligibility for an asbestos trust claim generally requires two core forms of proof: medical evidence of a qualifying asbestos-related disease and credible evidence connecting the claimant’s asbestos exposure to a company, product, operation or premises covered by that specific trust. Each trust establishes its own requirements through its Trust Distribution Procedures (TDP), so qualifying for one asbestos trust does not automatically qualify a person for another.

Basic Asbestos Trust Eligibility Requirements

The U.S. Government Accountability Office found that asbestos trusts assess claims under trust-specific TDPs. A qualifying claim typically includes a completed claim form, evidence of exposure to asbestos products or operations covered by the trust, and medical records sufficient to support the disease being claimed.

In practical terms, eligibility commonly depends on:

  • A disease recognized by the trust.
  • Medical documentation satisfying that disease level’s criteria.
  • Exposure attributable to a debtor, product, operation or premises covered by the trust.
  • Any required minimum exposure duration.
  • Any applicable exposure-date and latency requirements.
  • A sufficiently complete and timely claim.

Medical and Diagnosis Requirements

Trusts commonly recognize multiple disease levels, such as mesothelioma, lung cancer, other cancers, severe asbestosis and nonmalignant asbestos disease. The required medical proof varies by disease and trust.

GAO reports that claimants submit medical reports or records sufficient to support the specific diagnosis and, when applicable, a death certificate. Depending on the TDP, evidence can include pathology, cytology, radiology, physician reports, pulmonary-function testing or other medical documentation.

A diagnosis alone does not necessarily establish trust eligibility. The medical evidence must satisfy the criteria specified for the disease level being claimed.

Asbestos Exposure Requirements

The claimant must generally establish exposure for which the particular trust has legal responsibility. That can mean exposure to asbestos-containing products manufactured, sold, supplied, installed or otherwise associated with the debtor, or qualifying exposure at covered premises or operations.

Trust-specific rules matter. Some TDPs require a minimum number of months or days of exposure for particular disease levels. Others require additional Significant Occupational Exposure for certain lung-cancer, cancer, asbestosis or pleural-disease claims.

Mesothelioma criteria can differ from nonmalignant disease criteria. Never assume that the same exposure-duration requirement applies to every disease level.

Work History and Product Evidence

GAO identifies several forms of evidence used to establish occupational asbestos exposure, including work histories, Social Security records, invoices, employer records and deposition testimony from claimants or coworkers.

Useful evidence may include:

  • Social Security earnings records and employment records.
  • Union, military or personnel records.
  • Jobsite, shipyard, plant or construction records.
  • Invoices, purchase orders and product records.
  • Claimant or coworker affidavits when permitted.
  • Descriptions of job duties involving asbestos-containing materials.
  • Official trust product or approved-site resources when available.

A worksite known to contain asbestos does not automatically establish exposure to a product or entity covered by a particular trust. The evidence must satisfy that trust’s TDP.

Latency and Exposure-Date Requirements

Many TDPs impose a latency requirement—the minimum period between first qualifying asbestos exposure and diagnosis. A commonly encountered trust standard is approximately ten years, but the exact rule must be confirmed in the governing TDP.

Trusts can also impose a cutoff date for qualifying exposure. This date often reflects when the debtor stopped making or using asbestos-containing products, sold an operation, reorganized or otherwise ended the liability period covered by the trust.

A claimant should document first exposure, last exposure and diagnosis dates carefully. Incorrect dates can affect latency, disease-level eligibility and whether the exposure falls within the trust’s covered period.

Secondary and Household Exposure Claims

Some trusts permit claims based on secondary exposure, such as a household member’s exposure to asbestos fibers carried home on a worker’s clothing or belongings. These claims generally have additional proof requirements.

A secondary-exposure claimant may need to establish the occupationally exposed person’s qualifying exposure to the debtor’s asbestos, the claimant’s relationship or contact with that person, and the claimant’s own qualifying asbestos-related disease.

Secondary claims may be required to proceed through Individual Review rather than Expedited Review. Because these rules differ substantially among trusts, the specific TDP must be checked before filing.

Filing Deadlines and Statutes of Limitation

Eligibility can also depend on timing. TDPs commonly contain statutes-of-limitation provisions, initial filing dates, tolling rules or special treatment for claims affected by bankruptcy proceedings.

The relevant date can depend on diagnosis, death, the trust’s initial claims filing date, applicable state law and provisions in the confirmed bankruptcy plan or TDP.

Do not assume that a claim is automatically too late—or automatically timely—based only on the age of the asbestos exposure. Asbestos diseases often arise decades later, and trust documents contain specialized timing rules.

Current official filing instructions and TDP provisions should be reviewed for the specific trust and claim.

Expedited and Individual Review Eligibility

GAO found that trusts typically offer Expedited Review and Individual Review. Under Expedited Review, a claim that meets the presumptive medical and exposure criteria for a disease level is generally assigned that level’s Scheduled Value.

Individual Review provides claim-specific consideration and can result in a liquidated value above or below the Scheduled Value. Some disease categories or claim types may be eligible only through Individual Review.

Meeting the basic criteria to file a claim does not guarantee payment. The trust still evaluates whether the evidence satisfies its TDP, and an allowed liquidated value may then be subject to the current Payment Percentage and other payment provisions.
