Bankruptcy and Trust History

The official Trust states that the Plibrico Asbestos Trust was established on March 8, 2006 as a result of the Chapter 11 reorganization of Plibrico Company and Plibrico Sales and Service, Inc.

The current TDP identifies March 13, 2002 as the Petition Date. The TDP covers asbestos-related personal-injury and death claims caused in whole or in part by exposure to asbestos-containing products sold by the Plibrico entities or their predecessors for which those entities have legal liability.

The Trust is designed to process and pay qualifying claims generally on an impartial first-in, first-out basis while attempting to treat present and future claimants as equivalently as possible.

Disease Values and Claim Review

The October 1, 2024 Third Amended and Restated TDP publishes the following Scheduled, Average and Maximum Values:

Disease Level Scheduled Value Average Value Maximum Value
Mesothelioma — Level VII $350,000 $425,000 $750,000
Lung Cancer 1 — Level VI $120,000 $135,000 $200,000
Lung Cancer 2 — Level V None $45,000 $135,000
Other Cancer — Level IV $65,000 $70,000 $100,000
Severe Asbestosis — Level III $120,000 $135,000 $200,000
Asbestosis/Pleural Disease — Level II $15,000 Not separately stated $15,000
Other Asbestos Disease — Level I $1,500 Not separately stated $1,500

These are liquidated-value benchmarks, not guaranteed payments. Expedited Review is available for Disease Levels I–IV and VI–VII when the applicable medical and exposure criteria are met. Lung Cancer 2 claims must be handled through Individual Review.

Current 0.94% Payment Percentage

An official Trust notice dated August 27, 2024 reduced the Payment Percentage from 1.21% to 0.94%, effective October 1, 2024. The Trustee states that the adjustment was made with the consent of the Trust Advisory Committee and Futures Representative.

The notice also states that claimants receive payment on the gross liquidated value of their claims at the Payment Percentage in effect at the time of payment.

Mathematical illustration only — not a guaranteed payment. $350,000 Mesothelioma Scheduled Value × 0.94% = $3,290. The $425,000 Average Value × 0.94% = $3,995. The $750,000 Maximum Value × 0.94% = $7,050. A claimant is not guaranteed the Scheduled, Average or Maximum Value.

2024 Claim-Processing Changes

The Trust adopted additional claim-processing changes effective October 1, 2024. Processing of a claim that would not result in a payment of at least $100 is suspended until the Payment Percentage rises enough to produce a payment of at least $100.

The same official notice states that the statute of limitations for a suspended claim is tolled while that suspension applies, subject to the timing rules stated in the amended TDP and notice.

At the current 0.94% Payment Percentage, the published $1,500 Level I value would mathematically produce $14.10, so a claim liquidated at that value falls below the $100 processing threshold. By contrast, $15,000 × 0.94% = $141 before any other applicable adjustments.

The October 2024 amendments also set the sequencing-adjustment factor at 2.5% and cap the annual CPI-U adjustment to claim values at 2.5%, each subject to periodic review under the TDP.

Medical and Exposure Requirements

The current TDP requires disease-specific medical proof and qualifying Plibrico Exposure.

Mesothelioma Level VII requires a qualifying mesothelioma diagnosis and Plibrico Exposure. Lung Cancer 1 requires primary lung cancer, evidence of an underlying bilateral asbestos-related nonmalignant disease, six months of Plibrico Exposure, Significant Occupational Exposure and medical documentation establishing asbestos exposure as a contributing factor.

Other Cancer and Severe Asbestosis also require six months of Plibrico Exposure, Significant Occupational Exposure and disease-specific medical evidence. Level II requires qualifying asbestosis or bilateral pleural disease, pulmonary-function impairment, six months of Plibrico Exposure and Significant Occupational Exposure.

Exposure evidence can include credible proof connecting the claimant to asbestos-containing products sold by Plibrico Company, Plibrico Sales and Service, Inc. or covered predecessors.

Claim Filing and $52 Fee

Effective October 1, 2024, the Trust requires a $52 filing fee for each claim. The Trust will not process the claim or place it in the FIFO Processing Queue until the filing fee is paid.

If the fee is not received within 30 days after the Trust receives the claim, the claim is not classified as filed, the statute of limitations is not tolled, and the claim is withdrawn from Verus’s Claims Management System.

If the claim is determined to be compensable, the $52 filing fee is refunded in full when the claim is paid. Otherwise, the fee is non-refundable.

A claim also must be sufficiently complete to be reviewed, including a properly completed Claim Form or electronic filing and the required supporting medical and exposure documentation.

FIFO, Individual Review and Special Claims

Plibrico claims are generally processed according to a FIFO Processing Queue. Qualifying Disease Levels can use Expedited Review, while Individual Review is available in circumstances specified by the TDP.

Lung Cancer 2 claims are handled only through Individual Review. Claims in Disease Levels III–VII may also seek Individual Review when a claimant wants the Trust to evaluate a liquidated value above the Scheduled Value. Individual Review can result in a value below the Scheduled Value and ordinarily cannot exceed the applicable Maximum Value.

The TDP defines Extraordinary Claims to include qualifying claims where at least 75% of the claimant’s asbestos exposure resulted from a specific asbestos-containing product manufactured or distributed by the Plibrico entities or predecessors and there is little likelihood of substantial recovery elsewhere. Such claims undergo Individual Review and remain subject to the Payment Percentage and other Trust limitations.

The Trust’s public Notices page reviewed for this build contains an annual report for fiscal year 2013 but does not provide a sufficiently current audited 2025 or 2026 report establishing present total assets, cumulative claims paid or lifetime dollars paid. Those figures are therefore omitted rather than estimated or copied from law-firm or lead-generation websites.
