CPF’s current Eagle-Picher trust page states that Eagle-Picher Industries filed Chapter 11 bankruptcy petitions in 1991. The Eagle-Picher Industries, Inc. Personal Injury Settlement Trust was established on November 29, 1996 and began accepting claims on August 1, 1997.

A 2024 bankruptcy-court filing concerning amendments to the Trust Agreement confirms the trust’s purpose: to assume covered toxic personal-injury liabilities and use trust assets and income to pay holders of valid claims while treating present and future claimants in a substantially similar manner.

An official Eagle-Picher notice dated November 1, 2023 states that the Trustees approved an increase in the Payment Percentage from 33% to 35%, effective that day. The Trustees cited updated claim-filing trends, settlement values, investment performance, operating costs and actuarial projections. The Claims Resolution Procedures require the percentage to be reconsidered at least every three years and permit more frequent adjustments.

Current-verification note: CPF’s current Eagle-Picher materials reviewed for this update did not surface a newer official percentage notice superseding the November 1, 2023 increase. The percentage can change, so it should be rechecked when a claim is evaluated for payment.

Individualized Review Claims

Individualized Review is available across disease categories under the official Claims Resolution Procedures. Unlike the fixed Discounted Cash Payment schedule, Individualized Review evaluates claim value using the trust’s procedures and valuation approach. The applicable Payment Percentage limits what is paid on the full liquidated value.

The official 2023 payment notice states that the trust increased the percentage to 35% based on its evaluation of current claim and financial information.
